Terms and Conditions of Sale

1. Preamble

These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between Nuellia, operated by The Hana Bloom Agency (SIREN: 810 395 319), and its customers. All orders placed on our website www.nuellia.com are subject to these T&Cs.

2. Acceptance of conditions

By placing an order on our site, you unreservedly accept these T&Cs. We invite you to read them carefully before finalizing your order.

3. Orders

You can place an order on our site by following the indicated steps. Once your order is validated, you will receive a confirmation email. Nuellia reserves the right to cancel any order in the event of unavailability of the ordered product or a pre-existing dispute.

4. Price and payment

The prices of our products are indicated in euros (EUR) all taxes included (VAT). We reserve the right to modify our prices at any time, but products will be billed based on the rates in effect at the time of order validation. Accepted payment methods include credit cards (via Stripe) and PayPal.

5. Delivery

Products are delivered to the address indicated by the customer during the order. Delivery times vary depending on the destination: generally 3 to 5 business days for France, 3 to 9 business days within the European Union, and 5 to 9 business days for the rest of the world. Delivery costs are calculated based on the weight and destination of the order and are indicated before final validation. All orders within the EU are dispatched from our European warehouse — no customs duties or import VAT apply for EU customers.

6. Right of withdrawal

In accordance with EU Directive 2011/83/EU on consumer rights (applicable across the European Union), the User is informed that the right of withdrawal does not apply to food supplements in the following cases:

• The supplements are likely to deteriorate or expire rapidly;
• The supplements have been unsealed by the User after delivery and cannot be returned for hygiene or health protection reasons (Article 16(d) and (e) of EU Directive 2011/83/EU).

Outside these exceptions, the User enjoys a right of withdrawal of 14 calendar days from the date of receipt of the order, without needing to give any reason. To exercise this right, the customer must notify us at contact@nuellia.com before the deadline expires. Return costs are the exclusive responsibility of the Customer. The product must be returned in its original packaging, unopened and unused. Refunds will be processed within 14 days of receipt of the returned goods.

7. Legal guarantees

Our products benefit from the legal guarantee of conformity (articles L. 217-4 and following of the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the French Civil Code).

8. Liability

Nuellia's liability can only be engaged for direct and foreseeable damages. We cannot be held responsible for the non-execution of the contract in the event of stock shortage, force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications.

9. Protection of personal data

The processing of personal information collected for the purposes of distance selling is mandatory, this information being essential for processing and routing orders. This information is processed in accordance with our Privacy Policy.

10. Applicable law and disputes

These T&Cs are governed by French law. However, as required by EU Regulation No 593/2008 (Rome I) and EU Directive 2011/83/EU, consumers residing in any EU Member State retain the protection of the mandatory consumer rights provisions of their country of residence. In the event of a dispute, an amicable solution will always be sought first. EU consumers may also refer disputes to the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

11. Modification of T&Cs

Nuellia reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in effect on the date of the order.
